Force Witness
Doesn’t forcing a witness to swear on the bible go against the idea of separation of church and state?
The political doctrine of Separation of Church and State states that government and religious institutions are to be kept separate from each other. Alright, but why then do U.S. trails force witnesses to swear on the Bible before they testify in court? It seems highly contradictory.
No one can legally be required to swear on the Bible in the United States. Our Constitution specifically prohibits such a requirement in some cases.
From Article VI of the U.S. Constitution:
“The Senators and Representatives before mentioned, and the members of the several state legislatures, and all executive and judicial officers, both of the United States and of the several states, shall be bound by oath or affirmation, to support this Constitution; but no religious test shall ever be required as a qualification to any office or public trust under the United States.”
The above, by the way, is yet another example of the separation of church and state that the Founders intended, and was written into the original text of the Constitution.
Those who talk about the Pledge of Allegiance apparently don’t realize that it was not written until long after our nation was founded, and the words “Under God” were added in the mid-1950′s. It’s like reading the King James Bible and then saying “If English was good enough for Jesus it’s good enough for the immigrants”.
